Your two viable possibilities actually both could be correct and most likely are. Rag Epps getting a lousy misdemeanor charge when others are jailed for years over trespassing is typical of corrupt DOJ pretending to be about justice. They are only about injustice and going after political prisoners who reject this tyrannical administration.
I'd bet my house Epps is a DEA or ATF agent. He fits the physical profile. And by charging him with a misdemeanor, they kill three birds with one stone: cover for the feds, protecting Epps' cover, AND he WON'T BE A CONVICTED FELON UNABLE TO CARRY A FIREARM. THAT is the tell.
